Litigation & Disputes

We handle business disputes with the rigor developed at leading law firms and in-house litigation teams, combined with the responsiveness and practicality of a boutique practice.

Our founder, Yelena Ambartsumian, has over ten years of litigation experience, spanning appellate litigation in New York state and federal courts, complex commercial litigation, regulatory investigations, bankruptcy litigation, and bet-the-company litigation.

The firm’s litigation matters sit alongside our ongoing work as fractional and outside general counsel, where we manage and supervise outside litigators on "bet-the-company" disputes, third-party subpoenas, and regulatory matters. Our firsthand experience as litigators also informs our approach to drafting and negotiating commercial contracts.

    • Matters involving long-running payment disputes, failed collaborations, and multi-party commercial relationships, including negotiating and securing favorable settlements before and after suit is filed.

    • Recently secured a favorable settlement and recovery for a creative production company that had gone months without payment after successfully delivering a campaign.

    • Defense of companies accused of website ADA non-compliance.

  • Cases involving alleged unauthorized use of creative works (copyright infringement), disputes over ownership and licensing of content, and related contract and marketing claims.

EXPERIENCE AT LEADING FIRMS AND IN-HOUSE

Complex commercial & bet-the-company litigation at a premier global firm

  • As a Senior Associate in the Litigation & Arbitration group at Milbank LLP in New York, Yelena worked on complex domestic and cross‑border civil litigation, securities and commodities litigation, bankruptcy litigation, and regulatory (SEC and state attorneys general) and internal investigations.

  • She led and managed large teams of 20-50+ attorneys across multiple U.S. offices and handled all stages of fact and expert discovery, including drafting discovery requests and subpoenas, supervising document review and production, conducting meet‑and‑confers, and taking and defending depositions.

  • Her work included drafting high‑impact motions—motions to dismiss for lack of personal jurisdiction and for failure to state RICO and antitrust claims, Daubert and Rule 702 motions to exclude expert opinions offered in support of class certification, and oppositions to motions for leave to amend complaints.

  • While at Milbank LLP, Yelena received the Pro Bono Services award, for her dedication to pro bono litigation work, as well as the Rising Star (2018, 2019) distinction by Super Lawyers, in the category of litigation.

Art, copyright, and contract disputes at an art & entertainment boutique

  • As Of Counsel at Amineddoleh & Associates, Yelena handled litigation matters involving copyright infringement, in addition to corporate, transactional, and advisory work in the art and entertainment space.

  • That experience informs AMBART LAW’s ability to navigate disputes where intellectual property, marketing, and creative industries intersect.

Appellate experience

  • Yelena previously served as appellate counsel, including arguing an appeal from an adverse summary judgment decision and a motion to stay trial in the New York Appellate Division, and drafting numerous appellate briefs and motions focused on reducing or eliminating exposure.

  • Earlier in her career, she monitored the longest civil trial in New York State history (the “91st Street Crane Collapse”) as appellate counsel and was the lead drafter of a post‑trial motion for judgment as a matter of law that secured dismissal of all claims against the construction‑manager client, in a case where remaining defendants later faced a substantial damages award.

In-house experience

  • As General Counsel of an engineering consulting company, Yelena advised the business through a “bet‑the‑company” series of proceedings arising out of the COVID‑19 pandemic, working closely with executives and outside counsel to formulate and execute a comprehensive business and litigation strategy.
